What is an Appeal?

Sometimes, the trial of your personal injury case isn’t the end of your personal injury case. During some trials, something improper occurs that prevents the injured party from receiving the compensation or justice they deserved. If this is the case, an appeal may be necessary. An appeal is essentially a re-evaluation of a decision made during the course of a case.

What’s the Difference Between a Trial and Appeal Court?

While a trial and appeal have some similarities, there are a few important differences:

Trial

During a trial, the parties present their cases. This includes calling witnesses as well as presenting any relevant physical evidence (documents, reports, photographs, blueprints, etc) in front of a judge and jury. After the closing arguments, the jury will weigh the information and evidence. After deliberation, the jury will return with their verdict.

Appeal

While a party still presents their case in an appeal, they will not be given the chance to present any new evidence or “re-try” their case. There is no jury at an appeal, and it is focused only on specific decisions that were made during the trial and whether those decisions unjustly cost the appealing party a fair trial. Appeals are most often heard by a panel comprised of three judges, unlike a trial where only one judge and a jury are present.
